Terms of Service

By downloading, installing, accessing, or using the Gather AI application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms are entered into between you and Transcend Technologies, Inc. DBA Gather AI Apps ("Company," "we," "us"). Apple Inc. is not a party to these Terms.

If you access the Service through Apple's App Store, you acknowledge and agree:

• Developer Responsibility. Transcend Technologies, Inc. DBA Gather AI Apps, not Apple, is solely responsible for the Service and its content.
• No Apple Support Obligation. Apple has no obligation to provide maintenance, support, or warranty services for the Service.
• Warranty Defects. If the Service fails to conform to any warranty, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligation with respect to the Service.
• Product Claims. Transcend Technologies, Inc. DBA Gather AI Apps, not Apple, is responsible for addressing any product claims relating to the Service, including product liability, consumer protection, and intellectual property infringement claims.
• Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
• Export Compliance. You represent that you are not in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and are not on any U.S. Government prohibited party list.
• Usage Rules. Your use of the Service must comply with the Apple Media Services Terms and Conditions.

You must be at least 13 years of age to use the Service. Users between 13 and 17 must have parental or legal guardian consent. By using the Service, you represent that you meet these requirements. The Service is not directed to children under 13. If you believe a child under 13 has registered, contact info@isocialize.me immediately.

You agree to provide accurate, current, and complete information during registration and keep it updated. You are responsible for all activity under your account and for keeping your credentials confidential. Notify us immediately at info@isocialize.me if you suspect unauthorized account access.

Credit System. Gather AI uses a credit-based model. Free accounts receive limited monthly credits. Additional credits may be purchased or earned through subscriptions.

Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID Account Settings or through the in-app settings.

Free Trials. If a free trial is offered, any unused portion is forfeited upon upgrade to a paid subscription.

App Store Billing. Purchases made via Apple's App Store are billed to your Apple ID. Apple's payment terms and refund policies apply. Refund requests for App Store purchases must be submitted to Apple directly.

Direct Billing Refunds. For purchases made directly through our website, refund requests may be submitted to info@isocialize.me within 14 days of purchase.

Credit Expiry. Monthly subscription credits reset each billing cycle. Purchased credit packs are valid for 12 months.

Ownership. You retain ownership of original content you create. By submitting content to the Service, you grant Transcend Technologies, Inc. DBA Gather AI Apps a worldwide, royalty-free license to use, display, and distribute such content solely for operating the Service.

AI Content. Content generated using our AI tools is subject to the terms of underlying AI model providers (Google Gemini, Kling AI, MiniMax). You are responsible for ensuring AI-generated content complies with applicable laws.

Prohibited Content. You must not generate, upload, or share content that is illegal, hateful, defamatory, sexually explicit, violent, or infringes third-party rights. We may remove non-compliant content at any time without notice.

You may not use the Service to: (a) create non-consensual deepfakes or misleading synthetic media of real individuals; (b) harass, stalk, or harm any person; (c) reverse engineer or decompile the Service; (d) use automated scraping without authorization; (e) train competing AI models; (f) violate any applicable law or regulation; (g) impersonate any person or entity; or (h) interfere with the integrity or performance of the Service.

The Service, excluding user content, is the exclusive property of Transcend Technologies, Inc. DBA Gather AI Apps and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

You may request account deletion at any time via the Settings page. Upon request, your account enters a 30-day grace period during which you may cancel. After 30 days, your account and all associated data are permanently and irreversibly deleted. Certain financial records may be retained as required by law.

Our Privacy Policy describes how we collect, use, and share your information. By using the Service, you consent to those practices. Our Privacy Policy is incorporated into these Terms by reference.

The Service integrates with Google Gemini, Kling AI, MiniMax, Stripe, Resend, and Supabase. These services are governed by their own terms and privacy policies. We are not responsible for third-party service practices or failures.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRANSCEND TECHNOLOGIES, INC. DBA GATHER AI APPS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRANSCEND TECHNOLOGIES, INC. DBA GATHER AI APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Transcend Technologies, Inc. DBA Gather AI Apps and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

These Terms are governed by the laws of the State of Delaware, United States. Any disputes not resolved through good-faith negotiation within 30 days shall be resolved by binding arbitration in Wilmington, Delaware under the American Arbitration Association rules. You waive the right to participate in class action lawsuits or class-wide arbitration.

We may update these Terms at any time. We will notify you of material changes by posting updated Terms with a new effective date. Continued use of the Service after changes take effect constitutes acceptance.
