End User License Agreement

Subject to the terms of this EULA, Transcend Technologies, Inc. DBA Gather AI Apps grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Application on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service
• Access and use the Application for your personal, non-commercial purposes

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Application.

You agree that you will not:

• Copy or duplicate the Application except as expressly permitted by this license
• Modify, translate, adapt, or create derivative works based upon the Application
• Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Application
• Remove, alter, or obscure any proprietary notices (including copyright notices) in the Application
• Use the Application to develop a competing product or service
• Rent, lease, loan, resell, sublicense, distribute, or otherwise transfer the Application to any third party
• Use the Application for any unlawful purpose or in violation of any applicable laws
• Use the Application to infringe upon the intellectual property rights of third parties

The Application, including all intellectual property rights therein, is and shall remain the property of Transcend Technologies, Inc. DBA Gather AI Apps. The Application is protected by copyright law, international treaty provisions, and other applicable intellectual property laws. Transcend Technologies, Inc. DBA Gather AI Apps retains all rights not expressly granted to you under this EULA.

"Gather AI," the Gather AI logo, and other related marks are trademarks of Transcend Technologies, Inc. DBA Gather AI Apps. You may not use these marks without prior written permission.

You retain ownership of content you create using the Application. By submitting content through the Application, you grant Transcend Technologies, Inc. DBA Gather AI Apps a worldwide, royalty-free, non-exclusive license to use, display, store, and distribute your content solely for the purpose of operating and improving the Application. You represent and warrant that you have all rights necessary to grant this license.

Content generated using our AI features (images, videos) is produced by third-party AI systems (Google Gemini, Kling AI, MiniMax). You acknowledge that:

• AI-generated content may not always be accurate, appropriate, or suitable for all purposes
• The commercial use rights of AI-generated content are subject to the terms of the underlying AI providers
• You are solely responsible for how you use AI-generated content
• Transcend Technologies, Inc. DBA Gather AI Apps makes no warranty regarding the intellectual property status of AI-generated content

Transcend Technologies, Inc. DBA Gather AI Apps is solely responsible for providing maintenance and support services for the Application, as specified in this EULA and applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.

The Application may offer subscriptions and in-app purchases. All purchases are final and non-refundable unless otherwise required by applicable law. For purchases made through Apple's App Store:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Refunds are handled by Apple in accordance with Apple's refund policy

YOU ACKNOWLEDGE AND AGREE THAT:

• THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND
• TRANSCEND TECHNOLOGIES, INC. DBA GATHER AI APPS AND APPLE EACH DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• IN THE EVENT OF ANY FAILURE OF THE APPLICATION TO CONFORM TO ANY APPLICABLE WARRANTY, YOU MAY NOTIFY APPLE FOR A REFUND OF THE PURCHASE PRICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE HAS NO OTHER WARRANTY OBLIGATION WITH RESPECT TO THE APPLICATION

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRANSCEND TECHNOLOGIES, INC. DBA GATHER AI APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.

TO THE EXTENT NOT PROHIBITED BY LAW, TRANSCEND TECHNOLOGIES, INC. DBA GATHER AI APPS'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APPLICATION SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APPLICATION IN THE LAST 12 MONTHS OR (B) ONE HUNDRED DOLLARS ($100).

Transcend Technologies, Inc. DBA Gather AI Apps, not Apple, is responsible for addressing any claims you or any third party may have relating to the Application or your possession and/or use of the Application, including but not limited to: (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the Application or your possession and use of the Application infringes a third party's intellectual property rights, Transcend Technologies, Inc. DBA Gather AI Apps, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. You agree to promptly notify Transcend Technologies, Inc. DBA Gather AI Apps of any such claim at info@isocialize.me.

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

The Application uses third-party services that have their own terms and conditions. By using the Application, you agree to comply with the applicable terms of these third-party services, including:

• Google's Terms of Service (Sign in with Google, Google Gemini AI, Firebase, Google Analytics)
• Apple's Terms of Service (Sign in with Apple, App Store)
• Stripe's Terms of Service (payment processing)
• Kling AI's Terms of Service (video generation)
• MiniMax's Terms of Service (video generation)

Transcend Technologies, Inc. DBA Gather AI Apps reserves the right to terminate your license to use the Application at any time if you breach this EULA or our Terms of Service. Upon termination, you must cease all use of the Application and delete all copies from your devices. Termination does not limit any other rights or remedies available to Transcend Technologies, Inc. DBA Gather AI Apps.

You may terminate this EULA by deleting the Application from all your devices and requesting account deletion through the Settings page (subject to the 30-day grace period described in our Terms of Service).

This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, United States, excluding its conflict-of-law provisions. Any disputes shall be resolved in accordance with the arbitration provisions set forth in our Terms of Service.

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Transcend Technologies, Inc. DBA Gather AI Apps regarding the Application and supersedes all prior agreements and understandings.
